VRQ Terms and Conditions

These VRQ Terms and Conditions (“VRQ Terms”) govern the access to and use of our Virtual Rodeo Qualifier (“VRQ”) via a Website or Mobile App. The VRQ allows rodeo-industry event producers and collaborators (“Producers”) to track athlete participation in their Events, and permits users to nominate their performances in Events and accumulate points.
These VRQ Terms are subject to and form part of the RoLo User Agreement available at https://rodeologistics.co/vrq-terms-and-conditions/ Any capitalized but undefined terms shall have the meaning given in the User Agreement. We may periodically make changes to these VRQ Terms and will notify you by posting a revised version on a Website. The revised VRQ Terms will become effective immediately upon such notice, and your continued use of the Websites and Mobile Apps will constitute acceptance.
- THE EVENTS
Producers organize and produce professional rodeo series consisting of multiple Events with varying prize payouts. Producers may offer a variety of Events in the VRQ, such as Events with auto-qualification opportunities, championship exemption opportunities, and that provide consolation points to you. Any information about Producers and their Events in the VRQ are for informational purposes only and we make no representation and give no warranty regarding their accuracy. We have no control over any Events or your ability to nominate or qualify for them, or any Producer’s format of points. We are not responsible for the conduct, quality, safety, or legality of any Event or your participation in it.
THESE VRQ TERMS DO NOT GOVERN YOUR PARTICIPATION IN AN EVENT. IN ORDER TO PARTICIPATE IN AN EVENT FOR WHICH YOU MAY QUALIFY, YOU MUST BE PERMITTED BY THE APPLICABLE PRODUCER OF SUCH EVENT, AND YOUR PARTICIPATION WILL BE GOVERNED EXCLUSIVELY BY THAT PRODUCER. IN ORDER TO PARTICIPATE IN AN EVENT, YOU MUST COMPLY WITH ANY REQUIREMENTS AND ENTER INTO ANY SEPARATE AGREEMENTS THAT MAY BE REQUIRED BY THE PRODUCER OF SUCH EVENT.
ROLO EXPRESSLY DISCLAIMS, AND YOU AGREE TO RELEASE ROLO FROM, ANY LIABILITY UNDER THESE VRQ TERMS, INCLUDING WITH RESPECT TO YOUR ELIGIBILITY TO PARTICIPATE AND PARTICIPATION IN AN EVENT. FOR AVOIDANCE OF DOUBT, THE DISCLAIMER AND RELEASE IN THE PRECEDING SENTENCE WILL NOT WAIVE OR RELEASE OUR OR YOUR RIGHTS OR OBLIGATIONS UNDER ANY OTHER AGREEMENT BETWEEN US.
- QUALIFICATION FOR EVENTS
You can accumulate points for your performances in Events by “nominating” those performances in advance through the VRQ, as described below. Based on your points or prior performance, a Producer may also issue an exemption to qualification for an Event. Points for each performance will be awarded in accordance with the VRQ point system and a Producer’s format of points, if applicable.
- NOMINATIONS
A Producer’s Events will be identified in the VRQ, along with the competitive division (the “Division”) to which they have been assigned. You may nominate your performance in an Event by selecting it in the VRQ, together with your competition date, designated discipline, and paying the applicable fee (“Nomination Fee”) (which payments will be handled by our designated third-party payment processor). A portion of your Nomination Fee will include a non-refundable processing fee you pay to us for using the VRQ (“Processing Fee”). Any nomination in the VRQ will require payment of at least the Processing Fee.
Nominations must be completed (a) prior to the scheduled start time of the nominating athlete’s first competition or performance of an applicable Event or (b) as determined by the Producer. Acceptance of any late nominations for an Event is subject to the Producer’s approval. Any qualification deadlines that apply to an Event will be solely determined by the applicable Producer and will be posted in the VRQ.
The Nomination Fee for an Event, as determined by the Producer, will be identified in the VRQ prior to your confirmation of your nomination. The Nomination Fee for an Event is in addition to, and independent from, any registration fee or other cost of participating in the Event. You are responsible for paying any such other amounts required to participate in the Event.
If an Event permits multiple entries in a particular discipline (whether with different animals, as a member of different teams, or otherwise), you may separately nominate as many of your performances in such discipline as you desire. The applicable Nomination Fee must be paid for each such nomination. If you only nominate one performance but make multiple entries in such discipline, you will earn VRQ points (as described below) only for your best eligible result (if any). If you nominate multiple performances, you will earn VRQ points for each eligible result (if any), up to the number of nominations you make (and pay a Nomination Fee for).
We have no control over whether your nomination is accepted by a Producer. The Producer of an Event has sole and absolute discretion over whether your nomination of an Event is eligible and RoLo makes no warranties or guarantees that your nomination will be accepted by a Producer. Any disputes regarding the validity or timeliness of your nomination shall be strictly between you and the Producer of the Event you are nominating in.
- VRQ POINTS; PERFORMANCE RESULTS
You will be awarded VRQ points for any Event that you nominate to the extent that your performance qualifies under the VRQ point system and the Producer’s Event rules. Subject to a Producer’s Event rules, the proprietary VRQ point system awards a raw score for each round of competition at an Event, with up to the top ten money winners (as determined by the Producer of the applicable Event) in each discipline receiving fixed point totals for each round, and then the raw scores are adjusted based on (a) the round within the individual Event (in the case of a multi-round Event), (b) the Division to which the Eligible Event is assigned, and (c) the type of event within such Division.
A Producer may also award “consolation points” to competitors that nominate performances, but do not otherwise place high enough to earn points from such performances, at designated Events. The number of consolation points issued with respect to any discipline at any Event will be one-half of the lowest point total awarded to any competitor in such discipline at such Event, unless otherwise determined by a Producer. A Producer may also award “nomination points” to competitors that nominate performances, but do not otherwise place high enough to earn points from such performances at Events organized or sanctioned by another organization. The number of nomination points issued, if any, with respect to any discipline at any such Event will be determined by the applicable Producer from time to time in its sole discretion.
A Producer will maintain a running tally of the VRQ points leaders in each discipline and the qualification standings for each upcoming Event on the VRQ. Points will be awarded based solely on official results from each Event that are either communicated directly to RoLo by the Producer of such Event (or their authorized designees, such as event judges or other officials) or are publicly published in an independently verifiable source. You acknowledge and agree that RoLo shall have no responsibility for (a) the failure of any of the foregoing sources to timely provide official results or (b) the accuracy of the results we obtain from any of the foregoing sources and that we may use results from the foregoing sources without any obligation for further inquiry or investigation. If you believe that any results from the foregoing sources are inaccurate, it is your responsibility to contact the Producer of the Event to seek an adjustment to those results. Once points are initially awarded, we will only adjust those awards based on changes to results that are communicated directly to us by the Producer of the applicable Event.
RoLo will update the VRQ point leaderboard each week with VRQ points awarded for results of Events from the preceding week. It is your responsibility to monitor the VRQ point leaderboards for updates. In the event you dispute the VRQ points awarded for any nominated performance, you must notify the Producer of the dispute within 48 hours of the applicable VRQ point leaderboard update. Disputes not raised within such 48-hour period may be waived. If a timely dispute is resolved in your favor (i.e., different performance results are verified by the organizer of the applicable Event, or the point calculation for the applicable results is determined to be incorrect and is updated), the change to your VRQ points will be reflected in the next applicable VRQ point leaderboard update.
- POINT DISPUTES
RoLo has no responsibility for ensuring your points are correctly or timely reported for the VRQ point leaderboard. Further, we have no control over whether your points are deemed sufficient by a Producer to qualify for an Event. RoLo agrees to use commercially reasonable efforts to try to resolve a VRQ point dispute, but RoLo has no control over and shall not be responsible for the availability, responsiveness, or willingness to cooperate of any Producers or other third parties involved in any Events. RoLo cannot guaranty its or your ability to timely resolve any VRQ points dispute relating to disputed performance results, and we hereby disclaim to the greatest extent possible under applicable law any liability or other obligation that may arise from or relate to the inability to timely resolve any VRQ disputes. You are ultimately responsible for ensuring your points are accurately and timely reported and you are eligible to participate in an Event.
